Pirate Democracy

Written or sworn compacts — conduct, shares, compensation, punishments — signed before a voyage and enforced at sea. They descend from the buccaneers' chasse-partie that Exquemelin described in the 1670s and from privateering custom; the Golden Age refined the instrument rather than inventing it. Surviving sets (Roberts's, Phillips's, Lowther's) reach us mainly through Johnson's General History and trial records — firm evidence, with a printed filter.

A pirate captain held absolute command only in chase and battle; the rest of the time he governed by consent and could be voted out of the cabin. Deposals were routine — crews turned out captains for cowardice, cruelty, or plain bad luck — and the practice is attested across trial testimony and Johnson's accounts. Charles Vane, deposed by his own men in 1718 for declining a fight, is the textbook case.

The quartermaster was the counterweight: elected by the crew to distribute plunder, ration provisions, arbitrate quarrels, and check the captain between engagements. Johnson called him a 'civil magistrate' aboard; the office had no equal in merchant or naval service, and it is the clearest structural evidence of shipboard power-sharing.

Major decisions — where to cruise, which prizes to keep, when to fight — went to the company in council, one man, one vote, full-share men voting equally regardless of task. The franchise was real but bounded: forced men, boys, and the enslaved aboard often stood outside it. Equality before the mast had a perimeter.

The common council of the whole company was the ship's supreme authority: it chose destinations, judged serious offenses, and could overrule the captain in everything but battle. Witnesses at the Bonnet and Roberts trials described councils convening on deck over prizes and punishments — practice documented from hostile courtrooms, which makes it firm.

Plunder was divided by formula, not by rank's whim: roughly one share per man, a share and a half to two for the captain, a quarter more for the quartermaster, carpenter, or surgeon. Compare a naval prize system in which a captain could take hundreds of times a seaman's cut; the pirate ratio — rarely above two to one — is the flattest pay structure on the eighteenth-century sea.

The articles carried an injury schedule: set sums for a lost right arm, left arm, leg, eye, or finger, paid from the common stock before any division of shares. Exquemelin records the buccaneer version in the 1670s and Golden Age sets repeat it — a workmen's-compensation scheme afloat, decades before anything comparable ashore, born of the trade's plain arithmetic of risk.

Punishment was specified in advance and administered by the quartermaster or the company, not left to a captain's temper: forfeited shares for concealing plunder, marooning for desertion, death for deserting station in battle. The articles' penal clauses read less like liberty than like a workplace code with teeth.

Serious accusations went to a jury of the company — mock-formal 'trials' with the quartermaster presiding — and sentence followed the articles. The irony was not lost on contemporaries: men outside all law reproduced its forms at sea. How fair these proceedings were is harder to know; most descriptions reach us through Johnson's dramatization and the confessions of men facing the gallows.

Aboard a pirate, 'mutiny' lost its meaning: deposing the captain was a lawful act under the articles, done by vote and usually without blood. The gallows-path ran the other way — many pirate companies were born in mutiny against a merchant or naval commander, the moment a legal crew became an outlaw polity. Howell Davis's rise, and Roberts's election within weeks of his capture, show the machinery working.

Marooning was the code's ultimate sanction — a man set on a bare cay with a bottle of water, a pistol, and a charge of powder. It enforced the articles by exile rather than execution, and it cut both ways: deserters marooned by their companies, and captains, like Vane, cast off by vote. The threat mattered more than the practice; well-documented cases are few.

The articles said little about prisoners; practice ranged from courtesy to atrocity, tuned to reputation. Masters who yielded quietly were often released with their ships — Roberts returned vessels to captains who struck without a fight — while resistance, or a hated home port, could bring torture. Captives' depositions, like Captain Snelgrave's 1719 account, are among our best eyewitness sources for life under the black flag.

Each ship's articles were its own statute book, yet the clauses rhyme from crew to crew: shares, injury pay, gambling bans, lights-out, no fighting aboard. The recurrence suggests a common maritime legal culture carried from ship to ship by the men themselves — custom hardening into code wherever a new company signed.

Reputation was the pirate economy's cheapest weapon: a name for keeping terms made prizes surrender without a shot, and a name for cruelty could do the same. Flags, legends, and calculated theater — Blackbeard's slow-burning fuses — were investments in future surrenders. Here the evidence shades from firm (patterns in depositions) toward legend, and the legend was partly the point.
